We also require you to upload at least one picture of yourself to let other Swans know who they are talking to. It is totally up to you what picture you upload. Swanned will not intervene unless you use an inappropriate image that does not comply with our Terms and Conditions or policies.
Your Swanned profile and other information you make available via the app, including information you provide directly or indirectly through Facebook (e.g. photos, your name, age, approximate location), may be viewed by all Swans and also shared with individuals who may or may not be users.
To give you an example; a Swan may like the look of you and screenshot a picture of you to their friend who is not on the Swanned App. So remember, when using Swanned and messaging other Swans, you must be happy for anything you share to be seen in the public domain, and to be seen by both users and non-users of Swanned.

To provide and maintain our app and services: this includes the development and provision of the services you have purchased, or other purchases through our apps and services.

To process payments: we and our third party payment processors need to process your personal data in order to invoice, manage, and collect payments for our apps and services (although we ourselves do not hold or process any payment data as payments take place through the relevant app store).
For the above purposes, our legal basis for the data processing is that it is necessary to perform our contract with you for our apps and services.
To identify fake profiles and stop unacceptable behaviour: It’s important to us that all our users are genuine and behave in an appropriate manner as set out in our Terms and Conditions and policies.

To provide news, special offers and general information about: (i) other goods, apps, services, and events which we offer that are similar to those that you have already purchased or enquired about, such our exciting events, new partnerships, promotions and more that are relevant to the services we provide; (ii) selected third party goods and services (with your consent). These may be provided by email, SMS, push notifications, social media, or stickers and flyers. You always have the ability to opt not to receive such communications in the Settings within the app or by contacting us.
To ask you occasionally for feedback about our apps and services and how we can improve. We may use your phone number or email address to ask you to rate how we are doing.
To detect and present spam and fraud.
Legal defence or actions: we may use your information where required to protect and defend our legal rights or property.
For business transfers: We may need to disclose your information in the course of evaluating or conducting a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.
For other purposes: We may use your information for purposes such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our app and services, products, marketing, and your experience.

All information you provide us with is optional. We suggest you exercise caution when making information visible to others on your profile. Remember, the pictures you choose to use in your profile may suggest things about you, for example where you live, or where you like to go out. Managing your account and providing matches and recommendations normally also require the use of personal data, and some of these functionalities may not be available in full or in part if you do not provide data or have it deleted.

These recipients may be located inside and outside the UK, the European Union (with Iceland, Liechtenstein and Norway, the “EEA”), or Switzerland. Our servers are currently located in Australia.
In the case of service providers, where they require access to data in order to assist us in providing our apps and services, they are not permitted to use such data for any other purpose. In each case we have in place written data processing contracts and where required additional safeguards that enable transfers from the UK, EEA or Switzerland to happen in a way that ensures that data is handled in accordance with similar standards to those applicable in those territories. We may store data for internal purposes to help us understand statistics and demographic data about our users to help us improve. However this data will be retained in aggregated and anonymised form that cannot identify or be linked to any individual.

However, unfortunately no app, website or internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorised access, hacking, data loss or other breaches will never occur.

At any time you can ask us to stop processing your personal data or to exercise your other rights in relation to it, e.g.:
In our app itself, you can deactivate and delete your profile under account settings. When you do this there will be a 30 day cooling off period where your profile will not be public but we will store your data in case you change your mind. After this period all your data will be deleted. We delete all data associated with your account including images, messages, matches, and profile.
After such 30 day period, you will have to re-join and go through the onboarding process once again. We are not responsible for any information, pictures, comments, or other content that is deleted from our systems resulting from the deactivation of your account.After such 30 day period, you will have to re-join and go through the onboarding process once again. To prevent misuse of Swanned following deletion of a profile we may keep information we deem necessary to ensure that that user does not open a new account in breach of our Terms and Conditions and policies and to ensure compliance with applicable laws and regulations.
Even after you remove information from your profile or delete your account, be aware that copies of that information may still be viewable and/or accessed - for example if information has been previously shared with others, or copied or shared with search engines. We cannot control this and do not accept any liability for this. If you have given third party applications or websites access to your personal data they may retain such information to the extent permitted under their terms of service or privacy policies.
Where we process any personal data based on consent that you have given, then you are always allowed to withdraw that consent at any time (though the processing that took place before withdrawal will still be legal).
Please note that in some circumstances we may not be able to fully comply with a request, e.g. where are required to retain data in order to comply with legal, accounting, tax, or recordkeeping obligations.
We are always available through the contacts at the beginning of this Privacy Policy to help resolve any issues or doubts you may have in relation to processing of your personal data. If you believe that your rights have not been respected at any time then you also have a right to complain to the Data Protection Supervisory Authority in your country to ask them for a resolution.

Although we want those of all ages to find the swan they want, you must be at least 18 years old in order to use our app.
Swanned does not knowingly collect any information about, or market to children, minors or anyone under the age of 18. If you are less than 18 years old, we ask that you do not use our app. If we become aware that anyone under the age of 18 has registered with us, we will terminate that person's registration from Swanned. If we do delete a profile because a user violated our age rules, we may retain their email and IP address to ensure that they do not try to get around our rules by creating a new profile.
Our app and services may contain links to other apps or websites that are not operated by us. From time to time, Swanned may display deals and discounts from our partners in our app. It is at your own discretion whether you choose to interact with these deals. When you register via a third party social media platform like Facebook, you are also giving them personal data.
All these third parties’ privacy policies and practices are not within Swanned’s control and may differ from ours, so please review them when visiting those sites.
If you are or work for someone that we deal with in our business, including suppliers of goods or services (or potential suppliers), investors (or potential investors), and any other business contacts such journalists or influencers, we may store and process personal data needed for managing our relationship with you or your organization which may include: your name, organization name, position, professional qualifications or interests, mailing address, website, telephone numbers, e-mail addresses, details of products and services, payment information, and information provided to us in the course of correspondence with you (e.g. by email, phone, or messaging). Our legal basis for this data processing is that it is necessary for our legitimate interests which are not outweighed by your privacy rights and interests. As this data always relates to your professional life, its processing should have minimal privacy impact. You have the same rights as other individuals which can be exercised by contacting us as set out at the beginning of this Policy, although we may need to continue to process certain data in order to maintain our relationship with your organisation and the delivery of products and services.
